End-User License Agreement

1. Grant of License

fcvend - Commission Processing Service ("Service") is licensed, not sold. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms and conditions.

2. License Restrictions

You may not:

  • Reproduce, duplicate, copy, sell, or distribute the Service or any part of it
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for any unlawful purpose or in violation of any local, state, national, or international law
  • Harass, abuse, or harm any person or entity
  • Remove or alter any proprietary notices or labels on the Service

3. Intellectual Property Rights

The Service and all materials included in the Service, including without limitation all designs, text, graphics, pictures, video, information, applications, software and other files, and the selection and arrangement thereof (collectively, "Materials"), are the sole property of the Service provider. All rights in the Materials, including all intellectual property rights therein, are reserved.

4. User Data

You retain all rights to any data you upload to or process through the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use your data solely for the purpose of providing the Service to you.

5. Limitation of Liability

In no event shall the Service provider be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service, even if the Service provider has been advised of the possibility of such damages.

6. Disclaimer of Warranties

The Service is provided on an "as is" basis without any warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights.

7. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term(s) of this EULA. Upon termination of this EULA, you shall cease all use of the Service.

8. Governing Law

This EULA is governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts located in that location.

9. Entire Agreement

This EULA constitutes the entire agreement between you and the Service provider and supersedes all other communications and proposals, whether electronic, oral or written, between you and the Service provider.
